BetMGM refuses to pay millions owed to winner of online game

Our client, Jackie Davis, joined BetMGM in mid-March and spent a few days playing an online casino game, Luck O' the Roulette. Over the course of five days, Jackie won a total of over $3 million. While BetMGM allowed her to withdraw $100,000.00, the company suspended her account and refused to pay her the remaining balance - claiming a game malfunction voided the transactions. BetMGM has refused to pay Ms. Davis. See the Complaint here


In July 2022, the trial court granted Defendant's Motion to Dismiss, stating that Ms. Davis failed to show that the Michigan Gaming Control Board could not provide a remedy for this problem. A few days later, we discovered that the Board had actually resolved Ms. Davis's complaint to them, but that she was never notified of the outcome and could only receive more information through the filing of a Freedom of Information Act request. Upon receiving the Board's decision, which found that BetMGM had committed two violations, we filed a Motion for Reconsideration, showing the trial court once again that the Board cannot provide a remedy. When the trial court denied the Reconsideration, we promptly filed an appeal in the Michigan Court of Appeals.

On September 28, 2023, the Michigan Court of Appeals issued an Opinion affirming the trial court's decision with a strong Dissent. See the Opinion here. See the Dissent here.


After the Michigan Court of Appeals Opinion was issued, we promptly filed an appeal in the Michigan Supreme Court.


Attorneys Samantha Baker and David S. Steingold filed the Application for Leave, which was granted. Attorney Mark Granzotto filed the Brief on Appeal. Amicus Curiae Briefs were filed by the Michigan Gaming Control Board, the American Gaming Association, as well as Detroit Casinos such as Greektown, MotorCity, and MGM Grand. Oral Arguments were held on April 10, 2025. Attorney Mark Granzotto argued on behalf of Ms. Davis.


On July 22, 2025, the Michigan Supreme Court issued an Opinion reversing the Michigan Court of Appeals decision and remanding the case to the 3rd Circuit Court for further proceedings. See the Opinion here.
